These Terms of Service ("Terms") govern your use of the being.at website and services ("Service") operated by being.at / Lighter Odyssey ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
being.at provides a platform for tracking physical objects (such as lighters) via QR codes. Each object has a unique journey page where users can view and contribute to its story by adding text entries and photos.
The Service is provided free of charge for individual users. We reserve the right to introduce paid features or plans in the future with appropriate notice.
Some features of the Service require an account. When you register, you agree to provide accurate information and to keep your credentials confidential.
You are responsible for all activity that occurs under your account. If you suspect unauthorized use of your account, please contact us immediately.
We reserve the right to suspend or terminate accounts that violate these Terms.
You retain ownership of the content you submit to the Service, including text entries and photos ("User Content").
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to store, display, reproduce, and distribute your content as part of the Service. This license exists solely for the purpose of operating and improving the Service.
You are solely responsible for the User Content you submit. You represent and warrant that you have the right to share any content you upload and that it does not violate any third-party rights.
You agree not to use the Service to:
Upload content that is illegal, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
Upload content that infringes on the intellectual property rights of others.
Upload content containing malware, spam, or any form of automated data collection.
Impersonate another person or entity.
Attempt to gain unauthorized access to the Service or its related systems.
Use the Service for any commercial purpose without our prior written consent.
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts responsible for violations.

The being.at name, logo, and related marks are our trademarks. You may not use them without permission.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any content on the Service.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or EUR 100, whichever is greater.
This limitation of liability does not apply to damages caused by intentional misconduct or gross negligence, or to liability that cannot be excluded or limited under applicable law.

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany, to the extent permitted by law.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may update these Terms from time to time. Changes will be posted on this page with an updated "last modified" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
